Why is the Obama administration determined to do what’s wrong on immigration? Votes.

The federal government has just filed suit challenging the state of Arizona’s new anti-illegal immigration law. The basis? The Supremacy Clause, which says that federal law trumps state law.

But that argument should fail in a court of law because the Arizona law mimics the federal law. It basically gives the state a mechanism to enforce federal law, to turn over people police have a reasonable suspicion to believe may be illegal over to the feds.

The Supremacy Clause doesn’t preclude states taking action to enforce federal law.

The Supremacy Clause only comes into play when a state law is “contrary” to a federal law or the Constitution. And courts have ruled that the states have “concurrent authority” when state law only mimics federal law. — Five federal appeals courts have applied this in context of illegal aliens, upholding states’ rights to arrest illegals.

It sounds pretty straight forward. So why are Democrats showing Arizona so little compassion?

    Obama, as he has done so repeatedly in his shadowy past, is applying the Constitution’s supremacy clause on an ad hoc basis that suits HIS political agenda, as opposed to benefiting the nation.

    Here’s what the O-man had to say about California enacting auto emission standards more strict than the U.S. EPA in his January 2009 “From Peril to Progress” executive order:

    “…[T]he federal government must work with, not against, states to reduce greenhouse gas emissions. California has shown bold and bipartisan leadership through its effort to forge 21st century standards, and over a dozen states have followed its lead.     Now, here’s what the Executive… Clown said about Arizona’s reiteration of federal immigration law:

    “Into this [illegal immigration} breach, states like Arizona have decided to take matters into their own hands. Given the levels of frustration across the country, this is understandable. But it is also ill conceived. And it’s not just that the law Arizona passed is divisive -– although it has fanned the flames of an already contentious debate. Laws like Arizona’s put huge pressures on local law enforcement to enforce rules that ultimately are unenforceable.”

    Huh…

    Mr. President, with all do respect, you’re full of sh*t. You can’t have “it” both ways because it aligns with your personal, political beliefs and retain the respect of the American people. Something must give; with this issue, it’s the respect. Your actions reflect poorly on you personally, your administration, and the nation as a whole. And therein lies the tragedy that has become your presidency.

  2. While the Democrats keep assailing the Republicans with the assertion that they are the party of “NO,” OBAMA and the Democrats, with all their power of the majority, continue to come up with “NO” solutions to the problems the nation is faced with.

    No Jobs!
    No solution to the Gulf spill!
    No plan to enforce immigration law and secure the borders.
    No prosecution of voter’s rights violation in the New Black Panther Case.
    No Senate hearings for the OBAMACARE chief RATIONER.
    No regard for “We the People” with increased and continued debt creation.
    No regard for the Constitution with the OBAMA-clone Kagan appointment.
    No regard for fair elections with the “Disclose Act”..The Supreme Court has ruled.
    No American Exceptionalism ..US is an apologetic nation under Dems and OBAMA

    This independent is saying NO to the Democrats in NOVEMBER and NO to OBAMA in 2012.
